DMCA Takedown Policy

3. Procedure Upon Receipt of a Valid Notice

Once a proper infringement notification is received, Newyorkshelter will:

• Remove or disable access to the infringing material.
• Notify the content provider or user that we have removed or disabled access to the material.
• For repeat offenders, terminate such user’s access to the website and services.

4. Counter-Notification Procedure

If you believe that the material that was removed or to which access was disabled is either not infringing, or you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, you may send a counter-notice containing the following information to the Copyright Agent listed above:

• Your physical or electronic signature.
• Identification of the material that has been removed and the location at which the material appeared before it was removed.
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
• Your name, address, telephone number, and email address.
• A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located and that you will accept service of process from the person who provided notification of the alleged infringement.

5. Repeat Infringer Policy

Newyorkshelter takes intellectual property rights seriously. We will terminate the accounts of users who are determined to be “repeat infringers.” A repeat infringer is a user who has been notified of infringing activity more than twice or has had infringing content removed from our platform more than twice.

6. Modifications

Newyorkshelter reserves the right to modify, alter, or update this DMCA Policy at any time. Any changes will be effective immediately upon posting to newyorkshelter.com.
